“We, the jury, have concluded we cannot reach a unanimous decision,” the jurors said in a note to Judge Curtis Farber.
Farber ordered the jurors to continue deliberating. If they cannot reach a unanimous verdict, he said, then the court will need to schedule a new trial in front of a different jury.
“If you need readbacks or clarifications of the law, we stand ready to do so,” Farber instructed the panel. “I appreciate the process is difficult. Please continue to deliberate.”
Weinstein is charged with third-degree rape against former aspiring actor Jessica Mann, who claims the disgraced entertainment mogul assaulted her at a DoubleTree hotel in Manhattan in 2013.
He pleaded not guilty to the charge, and he has denied all allegations of nonconsensual sex.
The trial marks the third time Weinstein faces charges stemming from Mann’s allegations.
He was first convicted in early 2020 of third-degree rape related to Mann’s claims, but a New York state appeals court overturned the conviction in 2024, ruling that the trial judge had improperly allowed testimony about allegations not directly tied to the case.
Weinstein was again tried on Mann’s allegations last year, but the jury failed to reach a verdict on the count tied to her.
In that second trial, the jury convicted Weinstein of first-degree criminal sexual act for forcibly performing oral sex on former “Project Runway” production assistant Miriam Haley in 2006. He was acquitted on a second first-degree criminal sexual act charge stemming from a similar allegation by former model Kaja Sokola.
The day after jurors delivered that mixed verdict, Manhattan District Attorney Alvin L. Bragg said his office was “ready to go forward to trial again, after conferring with Jessica Mann.”
In recent years, Weinstein’s health has visibly declined and he has faced various medical issues, including a diagnosis of bone marrow cancer in 2024. He has been behind bars since 2020.
